The Court of Appeal has dealt with the discretion permitted to the satellite platform Freesat under the 'Code of practice on electronic programme guides' published by the communications regulator, Ofcom, pursuant to sections 310 and 316 of the Communications Act 2003, in JML DIRECT LTD v. FREESAT UK LTD
